16 CFR Part 313

FTC Privacy of Consumer Financial Information Rule

Prepared by Shubhank Suman · Last reviewed

Status not verified beyond supplied text

Legal character
Federal regulation
Region
North America

What it covers

Privacy notices and specified nonaffiliated-third-party disclosures of consumers’ nonpublic personal financial information. The supplied § 313.1(b) limits FTC rulemaking coverage to qualifying motor-vehicle dealers described in 12 U.S.C. 5519, rather than every financial institution.

Why it matters

Avoids confusing the FTC’s notice/sharing rule with its broader financial security rule or another regulator’s implementing regulations. Annual notices and opt-outs have express exceptions.

Refer to it when

Research a qualifying motor-vehicle dealer’s privacy notice, financial-information sharing or consumer opt-out arrangements.

AI, privacy and cybersecurity relevance

  • AI: Low

LOW RELEVANCE

No AI-specific regime; disclosures of covered financial data remain relevant to analytics providers.

Privacy

VERY HIGH RELEVANCE

Notices, disclosure limits and opt-out rights.

Cybersecurity

LOW RELEVANCE

This is not the written-security-programme rule.

Applicability

The FTC rulemaking-authority motor-vehicle institutions described in § 313.1(b), subject to the statutory dealer exclusions and personal-purpose information test.

Read first

§ 313.1(b) → .3 → .4-.9 → .10-.15 → Appendix A where a model notice is used.

Provisions / sections covered

§§ 313.1-.3 - Scope, model form and definitions

Initial, annual and revised notice, content, opt-out and delivery. Section 313.5(e) provides a conditional annual-notice exception; it is not an unconditional annual mailing duty.

§§ 313.10-.12 - Disclosure and reuse limits

Nonaffiliate disclosure, redisclosure/reuse and account-number marketing restrictions.

§§ 313.13-.18 - Exceptions and other laws

Service-provider/joint-marketing, transaction and other permitted disclosures, with conditions. Read State-law relationships and original transition provisions separately from later changes.
