HIPAA: United States

Prepared by Shubhank Suman · Last reviewed

CURRENT

Legal character
Federal statute + implementing rules
Region
North America

What it covers

HIPAA regulates Protected Health Information (PHI) and, under the Security Rule, electronic PHI (ePHI).

AI, privacy and cybersecurity relevance

  • AI: High
  • Privacy: Very High
  • Cyber: Very High

AI

HIGH

HIPAA becomes highly relevant to healthcare AI when an AI provider:

  • receives PHI
  • stores PHI
  • analyses PHI
  • creates PHI
  • transmits PHI
  • performs covered functions for a covered entity.

An AI vendor may become a business associate depending on its functions and relationship with the covered entity. (HHS.gov)

Cybersecurity

VERY HIGH

The Security Rule is one of the most important health-sector cybersecurity frameworks in the United States.

Applicability

Not every health-data company is covered.

HIPAA applies only to covered entities and their business associates.

Current validity

HHS continues to identify the existing Security Rule as the currently effective rule, while proposed strengthening amendments remain a separate regulatory proposal. (HHS.gov)

Read first

Privacy Rule → Security Rule → Business Associate Rule/BAA → Breach Notification Rule → 45 CFR §§164.308, 310, 312, 400–414.

CRITICAL CLASSIFICATION

PrivacyLawHub should not represent HIPAA as one standalone "privacy regulation."

The operational HIPAA framework includes:

  • Privacy Rule
  • Security Rule
  • Breach Notification Rule
  • Enforcement Rule.

WHO IT APPLIES TO

The HIPAA Privacy/Security rules principally apply to:

  • health plans
  • health-care clearinghouses
  • covered health-care providers
  • business associates.

HHS explicitly states that organisations which do not meet the definition of covered entity or business associate generally do not have to comply with the HIPAA Rules. (HHS.gov)

PRIVACY RULE

The Privacy Rule regulates:

  • use/disclosure
  • minimum necessary principle
  • patient access
  • certain amendments
  • accounting
  • permitted disclosures
  • business associates.

SECURITY RULE

HHS confirms the current Security Rule establishes:

  • administrative safeguards
  • physical safeguards
  • technical safeguards.

It protects ePHI maintained/transmitted electronically. (HHS.gov)

BUSINESS ASSOCIATES

Business associates can be directly liable for certain HIPAA requirements, including:

  • Security Rule compliance
  • impermissible PHI use/disclosure
  • breach notification
  • cooperation with HHS
  • minimum necessary requirements.

(HHS.gov)

BREACH NOTIFICATION

The Breach Notification Rule, 45 CFR §§164.400–414, governs breaches of unsecured PHI.

Affected individuals generally must be notified without unreasonable delay and no later than 60 days after discovery. Different rules apply to HHS notification depending on the number of affected individuals. (HHS.gov)
