Current validity
CURRENT: effective 15 August 2023
Read first
Articles 1–4 → Article 7 training data → Articles 9–12 service/privacy duties → Articles 14–17 safety/algorithm filing → Articles 19–21 enforcement.
Provisions / sections covered
Applicability: critical distinction
Article 2 applies to generative-AI services providing generated content to the public within China.
It expressly excludes R&D/use by industry organisations, enterprises, educational and research institutions, public cultural institutions and professional organisations where they do not provide generative-AI services to the domestic public. (Cyberspace Administration of China)
Important later development
China subsequently introduced the Measures for Identification of AI-Generated Synthetic Content, effective 1 September 2025, requiring visible and hidden identification mechanisms for AI-generated synthetic content. (Cyberspace Administration of China)
The associated mandatory national standard GB 45438-2025 is also currently effective from 1 September 2025. (Open Standards SAMR)
Therefore, the PrivacyLawHub page should cross-link these later instruments rather than presenting the 2023 Interim Measures as the whole current Chinese GenAI regime.
